I recently received a LinkedIn message from Digipulse Technologies
Position: IT Recruiter (Work from Home)
Requirements: US Residency, experience with W2 hiring in Java, Angular, Cloud, etc., familiarity with job boards.
Pay Structure:
$1000/month base pay + commission after 1st placement
$1500/month base pay + commission after 2nd placement
$2000/month base pay + commission after 3rd placement
$2500/month base pay + commission after 5th placement
Plus bonuses based on yearly targets.
Concerns:
No Base Pay Initially: The offer lacks an initial base pay for W2 employment, which seems unusual and potentially illegal.
Recruiter's Statements: The recruiter claimed no minimum base pay is required for W2 employees and that this is standard during a "learning process."
Potential Legal Violations: I'm concerned this may violate federal labor laws regarding minimum wage for W2 employees.
Question:
Is this type of pay structure for a W2 employee legal and acceptable?
